The idea that the times of politics are conditioned from judicial measures it resurfaces like a curse. And it is a curse not only for the elected officials but for the magistrates themselves. But the short circuit is lurking. Palazzo Chigi reacts to Delmastro’s indictment by saying that it is legitimate to ask whether a branch of the judiciary has chosen to play an active opposition role. And he thus decided to inaugurate the electoral campaign for the European elections prematurely.

These are accusations that anticipate new poisons. And they expose every power to the exploitation of the other. The temptation to respond by radicalizing the dialectic, by drafting reforms that sound punitive, can have boomerang effects. Instead of healing the anomaly, they perpetuate it and take it to the extreme, prefiguring a conflict from which both politics and justice would emerge defeated. The same tendency to wield guarantees as a banner against the intrusiveness of the magistrates promises to provoke above all misunderstandings and controversies.

It sounds like a reaction to justicialism grew up in the shadow of populist forces; and source of conflicts that have left a trail of misunderstandings and poisons still in circulation. But giving the sensation of replicating a confrontation inherited from the past, thinking of doing it from positions of strength, instead of healing an anomalous relationship promises to feed it and offer it an alibi. For the government, being able to escape this short circuit that exalts only the most radical positions will not be easy. Yet he will have to try to do so in order not to become a victim.
