“No urgent precautionary suspension of the order”. Thus the Lazio Tar rejected the requests of the unions who asked for the suspension of the ordinance issued by the Minister of Transport and which halved the duration of yesterday’s train staff strike. However, the judges did not reject the appeal of the Filt / CGIL on the decision taken by the minister Matteo Salvini.

In detail, the president of the third section of the Administrative Tribunal held that «the conditions pursuant to art. 56 Cpa which allows to obtain a monocratic presidential decree which orders provisional precautionary measures in case of “extreme gravity and urgency”. In addition, the Regional Administrative Court held that, in the light of a balancing of opposing interests, «it appears powerful (which has the right of precedence, ed) the interest of users who have relied on the continuity of the service ensured by the burdened provision and the consequent inconvenience they would suffer, aggravated by the extreme difficulty on the part of companies to promptly prepare the appropriate measures organizations in the protected area”. The hearing in closed session for the collegiate discussion of the appeal has been set for 4 September next. Filt’s general secretary, Stefano Malorgio, emphasized the appeal that will go ahead: “The suspension of the ordinance would not have been useful anyway because the strike was already over”.

Minister Matteo Salvini comments: «Appeals and insults do not stop or scare me, now I am counting on companies and unions finding an agreement that has been missing for too long. And next week we will work on the taxi issue, always following the principles of common sense, respect and guarantee for citizens, who cannot wait hours and hours under the sun in too many Italian cities”. And he underlined: “We have not canceled the right to strike, we have simply reduced it to 12 hours to allow people to go home after work”.
