The Court of Cassation decided to leave the anarchist Alfred Cospito
to “41 bis”. The judges of the “palazzaccio” in Piazza Cavour in Rome have in fact rejected the appeal of the anarchist on hunger strike for three months against the “hard prison” regime ordered against him almost a year ago, and confirmed in December by the court of surveillance.

The provision, at the time, was signed by former Justice Minister Marta Cartabia, and recently confirmed by her successor Carlo Nordio who rejected a request for revocation by Cospito’s defender, the lawyer Flavio Rossi Albertini. The surveillance judges had established that there had been no anomalies or forcing behind the decision to place the anarchist in the “41 bis”, and confirmed the danger that his violent proclamations sent from prison (where he has been locked up for 10 years) were gathered by militants in freedom, invited to carry out new attacks. A verdict that – according to the Attorney General of the Cassation which represents and had shared some criticisms of the prisoner’s defender – instead had to be annulled because it was poorly or badly motivated.

In particular, in the decision to leave the anarchist in the “hard prison” the connection between the writings sent by the prisoner outside the prison and the danger that the militants in freedom would move according to his indications had not been adequately demonstrated; there was no proof of the “factuality” and “current nature” of the connections between the inmate and his companions outside prison who could act on the basis of the indications received from their alleged “boss”. The Cassation instead decided that there are no defects in that verdict, and that therefore Cospito must remain “41 bis”.
