Surrogate motherhood: yes of the Commission to universal crime. Pd votes against +Europe’s amendments

The Justice Commission of the Chamber has concluded the vote on the amendments to the bill which declares gestation for other crimes universal, that is, prosecutable even if committed abroad. In particular, an amendment by the majority was approved which provides for the punishment of only Italian citizens. The opposition voted against. The formal green light, with the mandate for the rapporteur after the opinion of the other Commissions, will be given next week. For the formal go-ahead, the opinions of the competent commissions and the mandate for the rapporteur are still missing, but the measure is expected in the classroom on June 19th, as envisaged in the latest calendar. “We concluded the examination of the amendments with a small reformulation of the basic text”, explained the rapporteur Carolina Varchi, of Fdi. «The commission – said the rapporteur Carolina Varchi (Fdi) concluded the vote on the amendments to the bill. Thanks to the reformulated text, we extend the punishment to all conduct committed abroad and this will discourage recourse to this practice, thereby stopping procreative tourism and more generally that market that has formed, of which the recent fair in Milan it is testimony”. «Regarding the method followed – she added – I would like to underline that the skilful organization of the work on such a delicate subject prevented time limits from being reached, therefore, as rapporteur, I thank the president Ciro Maschio who avoided resorting to these tools which, although provided for by the regulation, would have exacerbated the debate”. Of the opposite opinion Riccardo Magi (+Europe): «the reformulation of the text with the amendment of the majority tries to put a patch on the abnormality of the claim to punish a foreign citizen in Italy for a conduct committed in a country where the Gestation for others it is legal, perhaps jointly, but it remains a juridical absurdity. Therefore, with the reformulation, the Canadian doctor who comes on holiday in Italy with the child he had with the Gpa is not arrested, but the Italian doctor who also had a child with the Gpa in Canada is arrested and goes back to see his parents in Italy”. Pd parliamentarians also voted against the two amendments by Riccardo Magi (+Europe) which aimed to decriminalize gestation for others (Gpa), presented to the pdl which declares Gpa a universal crime, being examined by the Justice Commission of the Chamber. The two amendments went in the opposite direction to the majority’s bill: the first eliminated the prison sentence, keeping the fine from 600,000 to one million euro; the second decriminalized the conduct by providing for an administrative fine from 5,000 to 50,000 euros. On both amendments, the Pd in ​​the Justice Commission voted against, like the center-right, while the M5s supported Magi’s proposal. These were the only two amendments in which the oppositions did not vote unanimously.
