With 94 votes in favour, 72 against and 2 abstentions, the Senate approved the Credits decree on Wednesday 5 April: the provision governing building credits linked to building bonuses, with Superbonus in the lead, becomes law. After the approval of the text in the Chamber on Tuesday, yesterday the government raised the question of trust and in the afternoon the go-ahead for Palazzo Madama arrived. And this despite the attacks by the opposition with the Five Star Movement which spoke of an obscene decree contesting the use of trust without the possibility of voting on any changes in the Commission: A provision that brings only micro-corrections that risk sending thousands of companies upside down. The Democratic Party, with Daniele Manca, attacks the unresolved problem of the transfer of credits: there are 19 billion credits, this decree does not say how to safeguard them.

The news

But the definitive ok introduces a series of novelties. Especially with regards to timing. The text approved by the Council of Ministers on February 16 provided for the immediate stop of the transfer of credits and the discount on the invoice for all building bonuses. Stop which, after examination by Parliament, instead provides for extensions. Like the one for single-family houses whose works, as of 30 September 2022, have reached at least 30% of completion: the 110% subsidy can be requested until 30 September 2023. Also extension of the assignment of credits for cases in which, as of February 17, the OK from the transferee had not yet arrived: possible until November 30, 2023 but with the payment of a late payment of 250 euros and only for expenses made in 2022. More time also for the tax deductions that can be spread over 10 years instead of 4, but only for expenses for the year 2022

The exceptions

Exceptions are also envisaged: the 110% subsidy of the Superbonus will be valid for damaged homes in the municipalities affected by earthquakes since 2009 and by the floods in the Marche region, for Iacp social housing, for non-profit organizations, for the removal architectural barriers and urban regeneration. Full deduction (at 110%) also for interventions on boilers, fixtures and photovoltaic panels but only with evidence certifying the start of the works (even just the purchase) before 16 February 2023

Tax credits

That of stranded tax credits remains the big problem: over 19 billion euros are stuck in the tax drawers of companies and individuals. But the government has tried to find solutions. Banks are given the possibility of converting their credits into BTPs but at least for ten years and starting from 2028. In the future, a financial platform managed by private individuals will be born where it is possible to buy or sell credits and thus release part of the problem credits. In the meantime, some banks have reopened to sales, such as Unicredit and Bpm. While yesterday Intesa Sanpaolo and Universit Luiss signed an agreement for the transfer of credits for a tax value of 60 million euros
