Of John Bianconi

Three names in the running: Daniela Bianchini and Fabio Pinelli, supported by the Brothers of Italy and the League, and Roberto Romboli, chosen by the Democratic Party

THE names in contention there were three, two registered centre-right is one centre-left, but in the last few hours they seem to have reduced to two. All jurists elected by Parliament on the indication of the parties (hence the brand, which does not mean belonging) including the new one Superior Council of the Judiciary elect today the vice president. That is, the one who in close contact with the head of state, president by right, will lead the self-governing body of judges for the next four years.

The most accredited trio includes the young lawyer and professor at Lumsa Daniella Bianchinichosen by Brothers of Italy; the fifty-seven-year-old criminal lawyer of the Court of Padua Fabio Pinelliindicated by the Northern League leader from the constitutionalist class of 1950 Robert Romboliselected from Democratic party. But the hypothesis of the first woman to hold that office, a novelty that seemed well seen even by a part of the togates, faded as the days went by. Leaving two men to contend for an armchair which, given the always hot climate of relations between justice and politics, has a strategic value for the robes and very relevant for the government and the majority that supports it. Which this time was able to elect 7 of the 10 lay people who make up the CSM (4 FdI, 2 Lega and 1 Forza Italia) leaving 3 in opposition (1 to the Democratic Party, 1 to the Five Stars and 1 to the Third Pole, which however in matters of justice is closer to the right than to the left). However, it will be the i twenty togatesalso polarized between right and left: on one side the 7 independent judiciary, on the other 8 progressives (6 from area, one independent and one democratic judiciary), in the middle the 4 centrists of Unit for the constitution, plus the only one elected in the anti-current quota.

No one has the numbers to start as a winner, and the choice of will be decisive Unicostwhose advisers have always said they want to decide without preclusions, on the basis of authority and experiencedeductible from curricula but also from the direct meetings that overlapped until yesterday evening. The acceleration of the settlement imposed by the ceremonies ofopening of the judicial year (fixed for tomorrow and Saturday) has pressed the time available. The only ones who have already openly declared their preference are the directors of Area in favor of Romboliwho in addition to being an esteemed professor emeritus was part of a Judicial Council (local branch of the CSM) and therefore already practical self-government. Someone has raised the issue of titles because as a pensioner he is no longer ordinary in business, but there are precedents that should safeguard his election. The 8 members of the civil society could vote for him judicial left, perhaps the 2 members professionally appointed by right (the first president, close to retirement, and the attorney general of the Cassation); with the 4 votes of Unicost and the other 2 lay opposition (in addition to his own) we would reach 17, that is the absolute majority required in the first two ballots. But there are doubts about the layman of strict Renzian observance, it is more likely that he will stop at 16.

On the opposite side the Professor Bianchinion good terms with the former magistrate undersecretary to the Prime Minister Alfredo Mantovanolooked into pole position in order to attract, in addition to the 7 votes of pro-government derivation, the other 7 of Mi and the secular envoy of the Third Pole (its leader Renzi chose the last two vice presidents: John Legnini, hijacked directly from Palazzo Chigi where he was undersecretary, and David Ermini before denying him). But the line of the Brothers of Italy is to focus on a candidate who maintains the unity of the forces of the majority and has the possibility of success for which, having assessed the difficulty in obtaining the majority (from the third ballot the relative one is sufficient, and in case of parity prevails the eldest, i.e. Romboli) within the centre-right, the alternative hypothesis of Pinelli, supported by Salvini, has taken shape. Which on the chessboard of the majority aims to subtract a square from the premier Meloni. Thanks to a name capable of triggering a potential transversality. The lawyer who is part of the Leonardo’s Foundation driven by Luciano Violante and his association Italy decidesa few days ago he published an article in the Md magazine with a dialogical and doubtful approach to the reforms announced by the government and opposed by magistrates: interceptions, separation of careers and mandatory prosecution. If Renziano and the anti-current converged on him, he would reach 16 votes, exactly like Romboli (with the solid support of Unicost). Half Csm against each other. And no one feels like ruling out surprises.
