The legislative decree 101 of 2018 provides for it, which transposed the European regulation on the protection of personal data, also called Gdpr.

This legislation establishes the minimum threshold at 16 years, with the possibility for the Member States to vary the national legislation without ever falling below 13 years. In March also the Ombudsman for children, in a letter addressed to the premier Giorgia Melonihad already asked the government to raise the age limit to 16 with a specific law as has already been done in Luxembourg, the Netherlands and Germany.
