For Marilisa D’Amico, full professor of Constitutional Law at the University of Milan, the proposal to make surrogacy a “universal crime” is unfeasible and even counterproductive

“We are facing yet another case of purely symbolic use of criminal lawi.e. a legislative intervention which, far from fulfilling the function of preventing and repressing the conduct subject to sanction, results in a mere proclamation of negative value towards the practice subject to censure, however lacking in real effectiveness on a concrete level”. So, interviewed by Il Foglio, Marilisa D’Amico, Full Professor of Constitutional Law at the University of Milan, comments on the proposal to make surrogacy a “universal crime”, punishable even if committed abroad by Italian citizens. On Wednesday, D’Amico was heard in the Justice Committee of the Chamber in the context of the hearings that are taking place precisely on the subject of the prosecution of the crime of surrogacy committed abroad. The bills have now become three: to the initial one advanced by the Brothers of Italy, the texts of the League and the Noi Moderati group have been added.
