Varese, the Fip Court of Appeal reduces the penalty by 5 points: from -16 to -11, Lombards out of the relegation zone

The Federal Court of Appeal of Federbasket partially upheld the claim of the Openjobmetis Varese Basketball against the penalty of 16 points in last year’s standings April 13th to be discounted in the current sporting year “for not having complied with the payment of all obligations towards registered members contrary to what was produced during admission to the 2022-2023 series championship”. The Federal Court had sanctioned the Lombard club “following the referral of the Federal Prosecutor for acts of sporting fraud and sporting offences”. The publication of the reasons has been set in ten days. On April 13, the Federal Court had also indicted the president of the company Marco Vittorelli until April 13, 2026 (3 years).
The Tepic case
The story is linked to the arbitration award brought by Milenko Tepic against his former club for a non-payment relating to the second year of his contract. The Serbian winger had signed a two-year deal with Varese in 2019, but then separated from the club after just 3 games. At the time of registration for the championship, in the documentation filed, Varese maintained that there were no debt situations with members, but the FIBA arbitration won by Tepic last November according to the Federal Court involves the violation of the rules FIP (companies that have awards in progress cannot be admitted to the championship) and therefore to -16, then reduced to -11. The accusation was that of having been admitted to the championship without having the requisites: companies with pending proceedings against registered members cannot join the championship.

With the new ranking the Openjobmetis goes back to 21, outside the relegation zone but not yet arithmetically safe, when there are two days left to go to the end of the championship. Before the penalty, Varese was well in the running for the play-offs.
