The new pro-life bill by Fratelli d’Italia: “Legal capacity is acquired from conception”

There is once again controversy over a bill by the Brothers of Italy, which presents a bill to the Senate with the first signature of Roberto Menia which aims to amend article 1 of the Civil Code, regarding the recognition of the legal capacity of individuals . According to the current Italian law, in fact, the recognition takes place from the moment of birth. Fratelli d’Italia would instead like it to be earlier, and to start from the moment of conception.

«It is a question of recognizing, even in the juridical sphere, that embryo, fetus, newborn, child, boy, adolescent, young, adult, elderly, old are different names by which an identical reality, an identical subject, the same being are indicated. personal, the same man», Menia explained in the presentation of the bill.

The proposal, filed by the FdI exponent on 13 January last, adds to the provisions on the matter signed by representatives of the other majority groups. That of Forza Italia with the first signature of Maurizio Gasparri deposited in October, which provides for the recognition of the legal capacity of the conceived, and one of the group leader of the Lega Massimiliano Romeo of 13 October, which provides in article 3 that «the conceived is recognized as a component of the family to all intents and purposes”. Finally, a bill by Isabella Rauti provides for the establishment of the ‘Day of the unborn child’.
