School-work alternation, the new Inail rules on compensation for accidents – Corriere.it

The rule on school-work alternation and on the distribution of compensation will undergo a change. The announcement comes from the ministers Giuseppe Valditara and Marina Elvira Calderone, respectively of Education and Labor, after the news that Inail (National Institute for Accident Insurance) will not pay any compensation to the parents of Giuliano De Seta, the 18-year-old student from Ceggia (Venice) who died on 16 September under the weight of a one and a half ton steel plate during his period of school-work alternation at BC Service, a company specializing in metal bending in Noventa di Piave. This is because the law currently in force provides for compensation only in the event that the intern is also the head of the family.

The table of January 12th

The alternation between school and work must be reviewed – said Valditara -: students and their lives must be protected. We are working to prepare more just and advanced legislation together with the Minister of Labour. Similarly, Calderone added that the current legislation on compensation for those who die during the school-work alternation period must be changed immediately and we will do it with the next decree we are working on these days, in the first useful regulatory vehicle. It was already planned for Thursday 12 January a technical table on safety and on the most urgent corrections and modernizations to be implemented according to the regulations in force. Not only the social and employers’ parties, but also the Ministry of Education and University, Inail and the National Labor Inspectorate will be present. An episode like the one that happened to Giuliano De Seta, who was in his fifth year at the technical institute of Portogruaro, was a serious defeat for the system created to protect the life of every worker, added Calderone.

The Inail rules will change

The Minister of Labor added that, both in terms of her political role and as a mother, I am aware that no financial compensation can ever ease their pain. But to this is added the sense of profound injustice that derives from the existing regulatory vulnerability which allows financial compensation to family members only when to suffer the fatal accident the main recipient of the income. This rule has been in force for too long to still survive in our legal system and has affected many other families in recent years. In 2022, accidents similar to those that happened to De Seta caused another two victims: Lorenzo Parelli, 18, during his last day of internship in a mechanical company in Lauzacco, in Friuli-Venezia Giulia, and Giuseppe Lenoci, just 16, in Marche.
