Pa, the amendment to the Legislative Decree arrives to equate Tfs to Tfr: with the go-ahead, loans are ok

Two amendments to the decree law containing urgent provisions for strengthening the capacity of the administrations signed by Lega (Laura Ravetto, Igor Iezzi, Simona Bordonali, Alberto Stefani and Edoardo Ziello) and Fdi (Lorenzo Malagola), if approved on 24 May next, could definitive end to a disparity. The possible green light to the amendments, in fact, would allow the personnel of the armed forces,
of the police, firefighters and teachers to obtain a bank loan guaranteed by the severance pay (Tfs) as currently happens to public employees and private individuals with the severance pay (Tfr). A measure, this, which could concern about 3 million public employees who until now only had at their disposal the possibility of salary-backed loans at subsidized rates.
The introduction of this measure would be at no cost to the State and would make it possible to remedy a situation much awaited by law enforcement and fire brigade personnel. The amendments provide for the insertion of an article 19 bis entitled ‘Guarantee on credit advances on the treatment of
end of service. «1. In order to improve the conditions of access to credit for personnel employed by public administrations pursuant to article 1, paragraph 2, of Legislative Decree No. 165 of 30 March 2001, on the amount of the severance indemnity, set aside constantly employment relationship, a guarantee may be granted for credit advances. To this end, in article 1, paragraph 1, second sentence of the decree of the President of the Republic no. 180 of 5 January 1950, after the words: “they cannot be transferred” the following are added at the end: instead they can be given pledged, pursuant to articles 2800 and following of the Civil Code, to guarantee loans other than those referred to in titles II, III and IV of this decree. The constitution of the pledge takes effect from the moment of its notification to the debtors, implemented in any form, provided it bears a certain date. 2. In article 1 of the decree of the President of the Republic n. 180 dated 5 January 1950, the heading is replaced by the following: (non-seizureability,
attachment, non-transferability of wages, salaries, pensions and other emoluments and related guarantees)”.
