The second line of sports investigations into Juventus has reached an important point. Sports agent Giuseppe Chin notified the defense of the deed of closure of the investigations concerning the salary manoeuvres (private agreements signed during the pandemic under which players deferred salary collection and not budgeted), land transfer deals with other teams such as Atalanta, Udinese, Sampdoria, Sassuolo, Cagliari, Bologna and relations with agents. Article 4 (on sporting loyalty) is contested by the former Juventus president Andrea Agnelli, the former manager Fabio Paratici, and the former vice president Pavel Nedved. For operations with the agents, however, the investigation concerns the sports director Federico Cherubini as well as a series of agents, from Davide Lippi to Giuffrida.

As regards the positions of the six clubs (Sampdoria, Atalanta, Sassuolo, Udinese, Bologna and Cagliari) that have negotiated, signed or in any case agreed to confidential agreements in transfer market transactions without filing federal forms and/or filing documents bearing agreements other than those concluded will be evaluated at the conclusion of the ongoing investigations by the judiciary.

Now the defenses have fifteen days to send memos or ask to be heard. Chin, after scheduling any matches, will then have another 10 days to decide whether to file (difficult) or defer and start a sporting proceeding starting from the first degree.

A new procedure

It is difficult to define the timing of this procedure: the Football Federation will try to complete the two levels of judgment by the end of this championship so that any penalties can be applied to the current season. But even in this case there will eventually be the possibility of appealing to the guarantee college.

What is Juventus at risk? A maximum fine or penalty in points. We should be within the scope of article 31 violations in management and economic matters with paragraph 3 which reads: The company that makes agreements with its members or in any case pays them compensation, bonuses or indemnities in violation of the federal provisions in force, is punished with fine from one to three times the amount illegally agreed or paid, to which the penalty of one or more points may be added

The appeal for the first strand

As is known, the Federal Court of Appeal has already sentenced Juventus to a 15-point penalty for capital gains, revoking the previous acquittal sentence. Why? Because new facts have occurred which, if known, would have directed the previous judgment differently. These new facts are found in the papers originating from the investigation by the Turin Public Prosecutor’s Office (with confessional value according to the Court) and which concern only Juventus, not the other clubs. Juventus appealed to the Board of guarantee at the Coni which will discuss the case on 19 April.
