The ordinary layoffs can also be triggered in the presence of exceptionally high temperatures – over 35 degrees centigrade – which prevent the carrying out of work phases in places that cannot be protected from the sun or which involve the use of materials or the carrying out of processes which cannot withstand the strong heat. The INPS rules, envisaged since 2017, are recalled by the INAIL decalogue on work in the event of red dot days from a climatic point of view.

The perceived temperature also applies

There are two reference documents: one the INPS circular 139 of 2017 and the other the 1856 message of the same year and of the same social security institution. This also applies to the so-called perceived temperatures, which can also be obtained from the weather reports, when they are higher than the real temperature. For this reason, when the cases highlighted above occur, therefore, temperatures perceived to be higher than 35 even if the real temperature is lower than the aforementioned value may constitute an event that entitles the wage integration treatment.

The trades

According to the INPS, extreme climatic phenomena have been linked to an increase in the risk of accidents at work and in 2022 it gave indications on which sectors are eligible for ordinary layoffs in the event of temperatures exceeding 35 degrees Celsius.

As underlined by the social security institution, the activities for which Cigo can be requested include, for example:
1) road surfacing works;
2) renovation of facades and roofs of buildings;
3) outdoor work requiring protective clothing;
4) but also all the work phases which, in general, take place in places which cannot be protected from the sun or which involve the use of materials or the carrying out of processes which cannot withstand the strong heat.

The documentation

When applying for ordinary layoffs for heat, the company must:
– send the application;
– attach the technical report where to indicate to Inps and Inail the days of suspension or reduction of work activities;
– also specify the type of processing in progress on the same days.

The company is not required to produce declarations certifying the extent of the temperature, nor to produce weather reports.
The two bodies point out that, regardless of the temperatures recorded in the bulletins, INPS recognizes the ordinary redundancy fund in all cases in which the company safety manager orders the suspension of work because he believes there are risks or dangers for the safety and health of workers, including cases in which the suspensions are due to excessive temperatures.
