The Minister of Justice: never seen a tax evader in handcuffs. The assumption that criminal law has a dissuasive or repressive effect is wrong

“We have a Lschizophrenic tax law and full of oxymorons. The Minister of Justice said, Charles Nordiotalking about the new penalty system provided by tax reform. «I was in the judiciary until 2017 and I’ve never seen a prison escaper in handcuffs. Which means that either something went wrong or we’re starting from the wrong principle. That is, that the penal law has a repressive dissuasive effect »adds the minister, he continues, «When the criminal decides to commit a crime he doesn’t go sifting through the penal code to see the sentence, he always thinks he gets away with it. All of this has however resulted in a series of absolutely useless criminal proceedingsharmful to all”.

The minister then explains the functioning of the sanction system which «represents a absolute novelty» and wants «speeding up and simplifying» on the basis of “conciliatory justice».. «Until 2017 – he explains – I was in the Public Prosecutor’s Office and I’ve never seen a prison escaper in handcuffs». There have been, however, «a series of useless and harmful processes for all who have absorbed the resources of the prosecutors, which could have been directed to prosecute more serious crimes ».

Apart from tax fraud, adds Nordio, for that matter the escape the new system of sanctions in the tax field is based on “two principles: regulatory simplification and conciliatory justice”. Even for the “honest” entrepreneur, Nordio clarified, “some violations would be found, because the rules contradict each other and perhaps by complying with one, there would be a violation of another”.

“I have always thought – Nordio added – that for what is simple tax evasion, i.e. the lack of agreement between the State and the taxpayer on the tax due, one must follow the principles of regulatory simplificationbecause we have an lschizophrenic tax law and full of oxymorons.
