Ciro Grillo, back to court. But the trial for violence could start from scratch – Corriere.it

The question is raised by the President of the Union of Criminal Chambers, Gian Domenico Caiazza. It comes from the pages de The Reformist and writes: “There are some of you who, as a defendant, would accept the idea that the judge – who has followed all the preliminary hearings on which your life more or less depends – goes away before concluding the trial ? And that he will be replaced by a judge who knows nothing of the trial, and who will get an idea by reading the minutes? I do not think so”.

The starting point for this reflection comes from the now famous Grillo case, the ongoing trial a Temple Pausanias (Sassari) for Cyrus Grillo (the son of the founder and guarantor of Cinquestelle, Beppe) and his three Genoese friends Vittorio Lauria, Edoardo Capitta and Francesco Corsiglia. The charge: gang sexual assault. The facts date back to July 2019, in Ciro Grillo’s holiday home in Sardinia, and there are two girls who signed the complaint, known by the (not real) names of Silvia and Roberta. Attorney Caiazza refers to a question that will be addressed in the courtroom today in Tempio: the transfer to Bari of one of the side judges of the trial and the possible (unconfirmed) transfer of the other side judge to a different office.

But it is by no means certain that all of this is happening today. Because before starting with the planned works, we need to deal with the issue of the judge(s) leaving. With the lawyers of the four boys ready to ask that he start over, if not all, a large part of the process. The defense team so far has always been compact. Alessandro Vaccaro, Gennaro Velle, Andrea Vernazza, Enrico Grillo, Ernesto Monteverde, Mariano Mameli and Antonella Cuccureddu have their eyes on the college and someone already has the request in their pocket to ask for the “renewal” of the process, as it is called in juridical.

Basically, when a judge changes renewal can be requested but before deciding on a possible request there is a knot to untie: the old rules are applied which put many stakes on such an eventuality, or the Cartabia law which, on the other hand, provides for it if the process has not been videotaped? And furthermore: between the abandonment of the old norm and the adoption of the new one there are transitional provisions and, as always, everything becomes interpretable. So this is what it is all about today: understanding if and which instances will be presented and interpreting the relevant laws. After that we will know if the Grillo case continues or starts over.
