Work on the Bari railway junction can restart. This was established by the ordinance with which on Saturday 17 December, the president of the fourth section of the State Council, Ermanno de Francisco, suspended the previous sentence of the Bari TAR which canceled the authorization environmental protection of the Region and suspended the works.
The house in dispute
The appeal had been presented by Rfi (Italian railway network), i.e. the entity that manages the 370 million euro contract financed with funds from the Pnrr. Circumstance, the latter, which has a weight in the decision of the judge of the Council of State. The ordinance states that work can resume. However, pending the discussion on the merits set for next January 12, they must take care not to concern the area (in the Municipality of Triggiano) where the house of the seven citizens who had promoted the original appeal to the Bari TAR is located. In summary: the works must also resume to avoid putting the funds of the Pnrr at risk, while the owners of the house could receive “the fullest protection” with expropriation and payment of the property at market prices in force before the contract and of the start of the works.
Lofoco the lawyer
The Council of State, according to the lawyer Fabrizio Lofoco who defends the owners, “has reiterated what it thinks” (in the sense that it has decided according to the previous ruling on the same question but in another stage of the proceedings). «However – says the lawyer – the environmental interest remains. It shouldn’t just be a question of private money. There is much more at stake and the modified track would save everything and everyone». He will discuss it again in the January hearing.
