TURIN. It counts as a goal, good for reopening a game and maybe then overturning it in extremis. The ruling by the Lazio Regional Administrative Court, which obliges Covisoc and the federal prosecutor’s office to deliver a copy of the note containing the “interpretative clarifications” on the capital gains affair involving Juventus to the defense within seven days, is an important point achieved by the Juventus lawyers in the delicate challenge with sports justice. The “note 10940” of 14 April 2021, the one in which the supervisory body asked the Federcalcio for clarifications reporting some suspicious market transactions, had so far been denied to those who had asked to be able to view it. That paper, according to the defense lawyers, could be a document capable of leading to the inadmissibility of the trial before the Federal Court of Appeal and therefore to the -15 ranking plus the heavy disqualifications of the managers for the violation of the procedural times. This was one of the points of Juventus’ appeal to the Coni Guarantee College, which still needs to be fixed on the agenda after the request presented by the Juventus club last week, given that the judges could backdate the terms of obligation to open the investigation and thus making part of the acts unusable.

The appeal presented by the current sports director Federico Cherubini and the former sports director Fabio Paratici, through the lawyers Clarizia, Paolantonio, Sangiorgio and Apa, was accepted on Monday evening by the administrative justice. The Regional Administrative Court, after a long technical sentence on the debated issue, considered that access to the correspondence between Covisoc and the Federal Prosecutor’s Office “is intended to protect not only the defense needs of the appellant, but the more general obligation of transparency of the administrative action” . As a result of the judges’ ruling, Covisoc will have to deliver the document in question by Monday. «It is evident – reads the sentence – the interest of the defensive access. The deed must be known before the sporting trial is concluded». In the opinion of the panel, however, “the lack of a precise discipline for the protection of access in the sports system” is a decisive fact; and the appeal in question «is certainly admissible» since the interest of the appellants is evident. From all this it follows that “the decline of competence of Covisoc to display the requested deed, which constitutes the substance of the denial contested here, is illegitimate”.

The sentence will be analyzed today by the Juventus Board of Directors which will meet at the Continassa headquarters to approve the accounts as at 31 December 2022. Judicial developments had forced the postponement of the Board of Directors for a week after the filing of the new documents by the Turin Public Prosecutor’s Office, in view of the preliminary hearing on 27 March on the Prisma investigation, while the closure of the investigation by the federal prosecutor on the salary maneuver is imminent with a new sporting trial on the horizon. The match is still long, but Juve scored their first goal. —
