Fictitious or inflated capital gains have been a financial doping for the A league in the last few years. And the effects on the budgets are likely to be serious. In the meantime, the investigations by the public prosecutors are multiplying in the Peninsula in the wake of or in connection with the Prisma investigation by the Turin prosecutors on the Juventus now being examined by the judge of the preliminary hearing.
The intervention of the magistrates
It is no news that the ordinary judiciary deals with events of this type. Usually, the checks on the hypotheses of an intentional alteration of the balance sheet results through the overvaluation of the price tags have run aground in front of the non-existence of objective methods to fix the fair value in this type of transaction.
At the end of July 2022, for example, at the end of an investigation into false corporate communications in relation to capital gains from “cross” transactions with theInter(in relation to the 2017/2018 and 2018/2019 financial years), the Milan Public Prosecutor ordered the archiving, noting that «the value of each athlete can only be entrusted to the concrete dynamics of the market in the absence of objective and predetermined parameters ».
The Prisma investigation
In the context of the Prisma investigation, the prosecutors instead formulated a request for indictment also on the side of fictitious capital gains, having acquired, through wiretapping and searches, material deemed probative.
Just the documentation collected in Turin and transmitted for territorial jurisdiction has led other prosecutors to take action. The line of opaque partnerships of the Juventus club, on which the sports prosecutor is still carrying out its checks, involves clubs such as Bologna, Cagliari, Sassuolo, Sampdoria, Atalanta and Udinese. According to what has emerged so far, some prosecutors have already opened files and ordered investigations such as in Cagliari, Bologna and Genoa and Udine.
