Border officials were authorized to expel anyone, indiscriminately, without verifying, as required by international law, the validity and legitimacy of the request for protection. All this, with the official justification of having to contain the infections. However, in 2022, President Biden revoked that article 42. The response of a group of Republican governors was immediate, they made a recollection and the Supreme Court agreed with them, thus making the law active again. Finally, it was the official declaration of the end of the pandemic that invalidated (definitively?) that article and therefore allowed the numerous asylum seekers to wait for the response of their request within the borders of the United States.

The main guidelines of migrants. It should be remembered that the vast majority of irregular immigrants who cross the southern US borders – according to surveys by the most important NGOs working in that area and assisting migrants in various ways – come from the largest and most populous Central American country, from Mexico , but also from El Salvador, Guatemala and Honduras. The main destinations that migrants-asylum seekers wish to reach are California, Texas, Arizona, New Mexico. A wave of more than 150,000 people is therefore expected. Biden did so by sending an additional 2,000 troops to the border to help the already present Border Patrol and National Guard officers.
